By accessing or using the Site, or by making a purchase, you agree to these Terms. If you do not agree, please do not use the Site.

The information on the Site is general in nature and does not constitute a binding offer. Order acceptance is subject to availability, payment validation, and confirmation by Market Bueno.

For purposes of these Terms:

“Customer”: any individual or company that browses, purchases, or requests a quotation.

“B2C”: sales to end consumers.

“B2B”: sales to businesses (for example, distributors, retailers, stores, restaurants, hotels, corporate clients, etc.).

“Seller” or “Brand”: a third party offering Products on the Site (marketplace), including affiliated brands or approved third parties.

“Target Regions”: United States, Latin America, and GCC countries (Gulf Cooperation Council).

“Non-perishable”: a Product that does not require a cold chain and has an extended shelf life (without prejudice to expiration dates).

You must have legal capacity to enter into contracts. If you act on behalf of a company, you confirm that you have authority to bind it.

3.2

You agree to use the Site lawfully and not to interfere with its security or operation.

3.3

We may restrict or suspend access to the Site if we detect misuse, fraud, abuse, or security risks.

4.1

Market Bueno’s target markets are the United States, Latin America, and the GCC. However, Product availability, payment methods, costs, and shipping times may vary by country/city.

4.2

For international or cross-border orders, the following may apply:

• taxes, duties, and customs fees;

• import requirements, registrations, labeling, or country-specific restrictions;

• additional validations by carriers or customs authorities.

4.3

Unless the Site expressly indicates otherwise, the Customer is responsible for costs and procedures derived from importation (duties, taxes, customs clearance, permits, customs delays, etc.).

4.4

Market Bueno does not guarantee that all Products can be imported into all countries. If an order is held or rejected by authorities or customs for reasons beyond Market Bueno’s control, the Customer assumes the associated risk and costs, to the extent permitted by applicable law.

5.1

Products offered may include non-perishable food and beverages, snacks, ingredients, and wellness products/tools.

5.2

We strive to describe Products accurately (ingredients, presentations, photos, sizes, origin). However:

• packaging, labels, batches, label language, or design may vary;

• images are for reference only;

• availability and prices may change without prior notice.

5.3

We reserve the right to limit quantities per order, reject orders, or remove Products from the catalog.

6.1

Market Bueno is a retailer/distributor/marketplace. We do not provide medical, clinical, or nutritional advice.

6.2

Nothing on the Site (including categories such as “healthy”, “wellness”, “fit”, reviews, or recommendations) constitutes medical advice, diagnosis, or treatment.

6.3

It is your responsibility to review labels, ingredients, warnings, allergens, and instructions for use, and to verify compatibility with your needs (allergies, intolerances, diets, pregnancy, medical conditions).

6.4

If you have questions, consult a healthcare professional before consuming or using any Product.

7.1

Some Products may be dietary supplements, vitamins, minerals, or other dietary supplements.

7.2

Supplements do not replace a balanced diet and their effects may vary.

7.3

To the extent permitted by law, Market Bueno does not guarantee specific results.

7.4

The Customer is responsible for verifying country-specific restrictions (for example, permitted ingredients, import limits, labeling, claims) and for consulting a healthcare professional when appropriate.

7.5

Unless otherwise stated on the Site or required by law, supplements may only be returned if unopened, sealed, and in original condition, within the timeframe indicated in the returns section.

8.1

Prices are displayed in the local currency or, if not available, in USD, and may or may not include taxes as indicated at checkout.

8.2

Shipping costs, additional charges, and applicable taxes will be shown at checkout before confirming the order.

8.3

We may correct typographical or pricing errors. If a Product appears with an incorrect price, we may cancel the order (and refund amounts paid, if applicable) or contact you to confirm whether you wish to proceed at the correct price.

9.1

An order is considered a purchase request. The purchase is confirmed only when:

• payment is approved/validated; and

• we send order/dispatch confirmation (by email or other means), or the order appears as confirmed on the Site.

We may reject or cancel orders for reasons such as lack of inventory, pricing errors, suspected fraud, delivery impossibility, breach of these Terms, or payment incidents.

10.1

We may use third-party payment processors (for example, Stripe) to process transactions.

10.2

Payment processing may be subject to the payment provider’s terms, in addition to these Terms.

10.3

Market Bueno does not control third-party systems and is not responsible for outages or errors attributable to the payment provider.

10.4

If chargebacks, fraud, or unauthorized use are detected, we may suspend transactions and cooperate with payment providers or authorities, as appropriate.

11.1

Delivery areas, estimated times, and costs are informed at checkout or on the Site. Delivery times are estimates and may vary due to logistics, weather, inventory, customs, holidays, or external causes.

11.2

You must provide a correct address and ensure receipt. If delivery is not possible due to Customer-attributable reasons, reshipments or additional charges may apply.

11.3

If you notice visible damage, missing items, or evidence of tampering upon receipt, you must report it within 24 hours with reasonable evidence (photos/shipping guide).

12.1

You may request exchanges or refunds only in accordance with this section and applicable law.

12.2

Non-perishable Products (food/beverages): returns are accepted only if the Product is unopened, sealed, in original packaging, and suitable for resale, within 14 days from delivery, except in cases of:

• incorrect or missing Product;

• defective Product;

• transport damage;

• or if applicable law requires different treatment.

12.3

Incorrect or missing Product: must be reported within 14 days of delivery.

12.4

Damaged Product: must be reported within 48 hours of delivery.

12.5

Supplements/vitamins: returns are accepted only if unopened, sealed, and in original condition, unless defective/damaged/incorrect or required by law.

12.6

Refunds, if applicable, will be issued to the same payment method (or as allowed by the processor) and may depend on bank/provider processing times.

13.1

Market Bueno may offer B2B sales (wholesale, retail, HORECA, corporate).

13.2

B2B conditions may include:

• minimum order quantities (MOQ);

• wholesale pricing and tiers;

• different delivery timelines;

• specific payment terms (for example, prepayment, net terms if agreed);

• return conditions different from B2C, as permitted by applicable law.

13.3

In B2B transactions, the written terms agreed in the quotation, purchase order, SOW, or relevant B2B contract shall prevail where not covered by these Terms.

14.1

Market Bueno may operate as a marketplace where approved brands and companies offer Products on the Site.

14.2

Brands may include clients/partners related to business ecosystems, as well as third parties that meet requirements (for example, internal “wellness/healthy” standards, documentation, and commercial guidelines).

14.3

When a Product is offered by a third party, the Site may indicate this (for example, “Sold by [Brand]” or equivalent). In such cases, depending on the operating model:

• the third party may be responsible for compliance (inventory, fulfillment, warranties); and/or

• Market Bueno may facilitate payment, support, or logistics, as indicated.

14.4

Market Bueno does not guarantee third-party performance unless it expressly assumes responsibility on the product page or in specific purchase conditions.

15.1

Coupons and promotions may have restrictions (validity, single use, excluded products, minimum purchase).

15.2

We may cancel benefits in cases of abuse, fraud, or breach of the Terms.

15.3

If subscriptions exist (for example, monthly boxes), renewal and cancellation conditions will be informed on the Site or in specific terms.

16.1

The Site, its design, text, logos, trademarks, catalog, and content are owned by Market Bueno or used under license.

16.2

Third-party trademarks and logos belong to their respective owners.

16.3

You may not copy, reproduce, or commercially exploit Site content without written authorization.

You agree NOT to:

20.1

To the fullest extent permitted by law, Market Bueno shall not be liable for indirect, incidental, special, or consequential damages, loss of revenue, or loss of opportunities.

20.2

Market Bueno shall not be liable for:

• allergic reactions or effects resulting from consumption/use when the Customer failed to review labels/warnings;

• logistical delays attributable to third parties or force majeure;

• packaging or batch variations;

• improper use of Products;

• import restrictions or customs decisions beyond our control.

20.3

Unless required otherwise by law, Market Bueno’s total liability related to an order shall not exceed the amount actually paid for that order.

You agree to indemnify and hold harmless Market Bueno and its team from claims arising from:

misuse of the Site;

21.2

fraud, chargebacks, or unauthorized use of payment methods;

21.3

breach of these Terms;

21.4

violation of third-party rights.

22.1

We may update these Terms at any time.

We will publish the current version with the update date.

22.3

If changes are material, we may notify you through reasonable means.

We may restrict Site access or cancel orders if we detect abuse, fraud, attacks, or breach of these Terms, without prejudice to legal rights.

24.1

These Terms shall be governed by the laws of the State of Florida, United States.

24.2

Any dispute shall be submitted to the competent courts of Florida, United States, unless applicable law provides otherwise or a different mechanism is agreed.
